2. Approval of the minutes of the Regular Council Meeting of January 13, 2009. (City Clerk) (See Backup)
3. Pursuant to City of Fort Walton Beach Code of Ordinances, Volume II, Chapter 4, Section 4.01, Paragraph 4.01.025 and the Purchasing Policies and Procedures, request authorization to award Bid #09-107 for the installation of five (5) stormwater pollutant separators to the lowest responsive, responsible bidder, Starfish, Inc. of Alabama, in the amount of $437,959.67, which includes the Base Bid of $424,849.67; Additive Alternative #1 for $5,835; and Additive Alternative #2 for $7,275.00. Staff further requests authorization for the City Manager, or his designee, to execute individual change orders in the not to exceed amount of $18,475, which is the remainder of the balance of the Florida Forever Grant Award, and authorization for the Purchasing Agent and City Attorney to draft contract. If approved, sufficient funding is available as outlined in the backup report. (Utilities Director) (See Backup) Synopsis: Authorizes purchase of five stormwater pollutant separators to provide for elimination of debris and other pollutants into waterways.
4. Pursuant to City of Fort Walton Beach Code of Ordinances, Volume II, Chapter 4, Section 4.01, Paragraph 4.01.025 and the Purchasing Policies and Procedures, request authorization to award Bid #09-105 for 50KW Emergency Generator, to the lowest responsive, responsible bidder meeting specifications, C&D Agency/Arcco Services, Covington, Louisiana, for the bid amount of $26,284, including optional extended warranty and spare Kassec engine control board. If approved, sufficient funding is available as outlined in the backup report. (Utilities Director) (See Backup) Synopsis: Authorizes purchase of one 50KW generator to support lift station operations in times of power failures.
5. Pursuant to City of Fort Walton Beach Code of Ordinances, Volume II, Chapter 4, Section 4.01, Paragraph 4.01.025 and the Purchasing Policies and Procedures, request authorization to award Bid #09-111, Cemetery Burial Services, to the highest ranked company, as outlined in the backup material, to Gulf Coast Wilbert, Inc, and authorize the Acting City Manager to execute the contract. If approved, sufficient funding is available as outlined in the backup report. (Recreation & Cultural Services Director) (See Backup) Synopsis: Awards bid for opening and closing of graves in the City's cemeteries.
6. Consideration of a request for authorization for the Acting City Manager to renew the group medical insurance with Blue Cross/Blue Shield of Florida for the plans and associated premiums recommended in the staff report. (Administrative Services Director) (See Backup) Synopsis: Renews City's contract for medical insurance.
7. Consideration of a request to authorize $5,000 for Dr. Herb Marlowe to facilitate the 2009 Strategic Planning Session. If approved, funding is available as outlined in the backup report. (Administrative Services Director) (See Backup) Synopsis: Authorizes $5,000 to facilitate the 2009 Strategic Planning Session.
8. Consideration of Resolution (09-5) providing for the compensation of the Acting City Manager and providing an effective date. Also, respectfully request approval of the Agreement for Services. (Administrative Services Director) (See Backup) Synopsis: Provides for employment of Acting City Manager.

Consideration of Ordinance (1772) of the City of Fort Walton Beach, Florida; amending Section 16.125.2, Sign Code, of the Land Development Code, to increase the number of monument signs allowed for certain multi-tenant centers; and setting an effective date. Municipal Planning Board Recommendation: Approval (3-2) (12/4/08)
Synopsis: Amends Sign Code to allow for additional signage at shopping centers having more than 100,000 square feet of tenant space.
11. Recommendation to amend Table H1 to include Kepner Drive Water Main Replacement Project.
11a) Consideration of Ordinance (1784) of the City of Fort Walton Beach, Florida; amending the Comprehensive Plan of the City; adopting text amendments to the Capital Improvements Element to update the schedule of Capital Improvement projects, and to incorporate by reference the Okaloosa-Walton Transportation Planning Organization's Transportation Improvement Program 2009-2013 and the Okaloosa County School Board's 2008-09 School Facilities Work Plan; providing for severability and an effective date. Synopsis: Updates the required Capital Improvement Element of the Comprehensive Plan.
12. Consideration of Ordinance (1789) of the City of Fort Walton Beach, Florida; providing authority and intent; amending Section 53 of the City Charter to remove archaic and inapplicable provision that was nullified and repealed by the Home Rule Powers Act of 1973; and providing an effective date. (City Attorney) (See Backup) Synopsis: Eliminates reference to position of "recorder" found in the City Charter.
13. Consideration of Ordinance (1790) of the City of Fort Walton Beach, Florida; providing for authority and intent; amending sections 21, 22 and 23 of the City Charter to remove archaic and obsolete provisions regarding finance procedures; amending section 53 to remove the Finance Director as an officer appointed by the City Council; and providing an effective date. (City Attorney) (See Backup) Synopsis: Removes the Finance Director as an appointed officer to a regular employee.

15. Consideration of approval of the Collateral Assignment of Development Agreement between City of Fort Walton Beach and Ft Walton Development Partners LLC to the Georgian Bank and authorization for the Mayor and City Clerk to execute that document on behalf of the City upon sufficient proof from the developers of a performance and payment bond of no less than $4,250,000. (City Attorney) (See Backup) (ITEM WITHDRAWN AT LAST MEETING) Synopsis: Allows the City to accept collateralization of the proposed parking garage from the financing entity.
16. Consideration of a request for authorization to change the Capital Improvement Program to include the replacement of 1,650 linear feet of 2-1/4" galvanized iron water main on Kepner Drive between Okaloosa Road NE and Choctawhatchee Road NE in the not to exceed amount of $35,000 using 2005 Utility Bond funds that were originally earmarked for water main replacement projects. If approved, sufficient funding is available in the WWTP Improvement account and will be moved to the 2-1/4" Water Main Replacement Account, as outlined in the backup report. (Utilities Director) (See Backup) Synopsis: Due to continual customer complaints about severe water discoloration, staff is requesting an expenditure from 2005 Utility Bond funds to replace an obsolete, undersized, water line.
